PITTSBURGH – A Pennsylvania man who posted pro-terrorist songs online before being accused of having a loaded gun and biting two FBI agents will remain jailed until a federal judge can hear the appeal of an order to release him to a halfway house.
Federal prosecutors were expected Friday to file the appeal of a lower judge's order in the case of 21-year-old Emerson Begolly (buh-GOL'-ee).
Begolly was arrested Tuesday in New Bethlehem, 50 miles northeast of Pittsburgh.
A federal magistrate Thursday granted his conditional release but delayed it a day to give prosecutors time to appeal. Instead, prosecutors were granted a stay keeping him in jail until a district court judge hears why he should or shouldn't be released pending trial. The appeal hearing hasn't been scheduled.
Begolly's attorney says she's trying to have him released to his father.
